The main obligation of the lessor under the land plot lease contract is to provide the lessee with the plot to in the condition complying with the contract terms and designated purpose of the land during the period prescribed in the contract.
The lessor is responsible for the drawbacks of the leased land plot, except for the cases when the lessor himself has specified their existence upon signing of the contract.
In addition, upon signing of lease contract the lessor is obliged to notify the lessee about all third party rights to the leased plot (easement, lien, etc.).
Usually the land plot lease contract is signed for a fixed period. Upon its expiry the obligations under the contract are also terminated, and the land plot is returned into the possession and use of the owner in the state, in which it had been received by the lessee, taking into account the "normal wear", or in the state preconditioned by the lease contract.
The RF Land Code entitles the lessee, except for some cases, to the same land use rights as the owner:
- to use the land plot in compliance with its designated purpose and lease contract terms, otherwise the lessor shall be entitled to claim termination of the contract and reimbursement of damages;
- may make different improvements in the course of plot use.
If such an improvement may be separated from the plot - it shall be the property of the lessee, but more often the land plot improvements are inseparable from the land. In such case after termination of the lease contract the lessee is entitled to reimbursement of the cost of improvements made by him at his own expense, if they were made by consent of the lessor.
